Улсын Их Хурлын Хууль зүйн байнгын хорооны өнөөдрийн (2025.04.16) хуралдаан гишүүдийн 63.6 хувийн ирцтэйгээр, 10 цаг 14 минутад эхэлж, Улсын Их Хурлын гишүүн Х.Тэмүүжингээс 2025 оны 04 дүгээр сарын 07-ны өдөр Улсын Их Хурлын даргад өргөн барьсан Үндсэн хуулийн цэцэд хүсэлт гаргах тухай асуудлыг үргэлжлүүлэн хэлэлцлээ.
Уг асуудлыг Байнгын хорооны 2025 оны 04 дүгээр сарын 15-ны өдрийн хуралдаанаар хэлэлцэх үеэр Х.Тэмүүжин гишүүний саналын үндэслэлийг боловсронгуй болгох шаардлагын улмаас хойшлуулах санал гаргаж, үүнийг гишүүдийн олонх дэмжсэн юм. Гишүүд хэлэлцэж буй асуудалтай холбогдуулан асуулт асууж, хариулт авсан тул өнөөдрийн хуралдаанаар санал хураалт явууллаа.
Монгол Улсын Их Хурлын чуулганы хуралдааны дэгийн тухай хуулийн 88 дугаар зүйлийн 88.1 дэх хэсэгт “Монгол Улсын Үндсэн хуулийн Жаран зургадугаар зүйлийн 2 дахь хэсэгт заасан асуудлаар гишүүн Улсын Их Хурлаас Цэцэд хүсэлт гаргах саналыг Улсын Их Хурлын даргад өргөн мэдүүлбэл уг асуудлыг Хууль зүйн байнгын хороо ажлын 14 өдрийн дотор хуралдаанаараа хэлэлцэж саналд дурдсан асуудал нэг бүрээр санал хураан нэгдсэн хуралдаанд санал, дүгнэлтээ оруулна” хэмээн заасныг Байнгын хорооны дарга Д.Цогтбаатар хуралдаанд танилцуулаад санал хураалт явуулав.
Үндсэн хуулийн цэцэд маргаан хянан шийдвэрлэх ажиллагааны тухай хуулийн 14 дүгээр зүйлд заасан “Аль ч шүүх авч хэлэлцэхгүй байгаа эрх зүйн маргааны хэргийн харьяаллыг тогтоолгохоор иргэн, албан тушаалтан, төр, олон нийтийн байгууллага Үндсэн хуулийн цэцэд гомдол гаргавал хэргийн харьяаллыг тогтоож холбогдох шүүхэд шилжүүлнэ” гэсэн.
Энэ нь Монгол Улсын Үндсэн хуулийн зарим заалтыг зөрчсөн гэх үндэслэлтэй талаар Улсын Их Хурлаас Үндсэн хуулийн цэцэд хүсэлт гаргах саналыг Байнгын хорооны хуралдаанд оролцсон Улсын Их Хурлын 15 гишүүний 12 нь дэмжив. Иймд энэ талаарх санал, дүгнэлтээ чуулганы нэгдсэн хуралдаанд танилцуулахаар боллоо хэмээн Улсын Их Хурлын Хэвлэл мэдээллийн газраас мэдээлэв.
